11. Summary of the new findings of the thesis:

This is the first scientific work in Vietnam's criminal law science at the level of doctoral of jurisprudence, in which the theoretical and practical issues of exemption from serving penalties under Vietnam's criminal law. The research results in the thesis have made the following new scientific contributions:

1) The thesis clarifies the system of theoretical issues about penalty exemption under criminal law (concepts, characteristics, bases of penalty exemption and factors affecting exemption from execution of penalty punish...). On that basis, build a scientific concept of exemption from serving penalties;

2) Systematize the history, analyze the origin and the development of exemption from serving penalties in Vietnam's criminal law from 1945 to date to make comments and assessments;

3) Studying the provisions of Vietnam's Criminal Code 2015 in comparison with criminal laws of some countries in the world on exemption from serving penalties to draw remarks, assess the similarities and differences as a basis for the acquisition of criminal legislative experience in this area;

4) On the basis of analyzing and assessing the shortcomings and limitations in the practice of applying the regulations on each case of penalty exemption, the thesis points out the necessity of continuing to improve the law, in which propose and continue to amend and supplement the provisions of the Penal Code 2015 on each case of penalties exemption and feasible solutions in order to improve the practical application.

12. Practical applicability, if any:

The study demonstrates the fact that scientific principles developed in the thesis, conclusions and recommendations can (potentially) be used by agencies in the criminal justice system to build - enforce criminal policies, especially for the requirement to continue completing the 2015 Penal Code in the legislative aspect of exemption from serving penalties.
