11. Summary of the new findings of the thesis:

This is the first monograph to comprehensively study the theoretical and practical issues about the criminal record institution in the criminal law science in Vietnam at the doctor of jurisprudence dissertation level since the first codification (law) (the Criminal Code 1985). In the dissertation, the author represents the new scientific contributions to the the following main contents:

Firstly, in the dissertation, the author has clarified the theoretical issues to build a scientific concept of criminal record institution (criminal record concept, criminal record institution, characteristics, and basis of provision, and legal consequences of criminal record);

Secondly, to study the criminal record provisions under the Criminal Code of Vietnam in comparison with the Criminal Code of some countries in the world (Russian Federation, Japan, the Federal Republic of Germany, the Republic of France and the Kingdom of Sweden) to draw the experience for our country;

Thirdly, to analyze the history of formation and development of the criminal record institution since the August Revolution 1945 until now, thereby to obtain the comments and assessments;

Fourthly, on the basis of analyzing and assessing the limitations and shortcomings from the provisions of the Criminal Code, the practice of implementing (applying) the provisions on the extent of ​​criminal record institution, in the thesis, the author proposes the requirements of the continuation to complete the laws and the perfect solutions, as well as to ensure the application of the Criminal Code’s provisions on this institution.

12. Practical applicability, if any:           

To study and assess properly the application of criminal record institution to the practical implementation, and simultaenously to analyze the limitations and shortcomings from the provisions of criminal record institution under the criminal law in Vietnam, in order to propose and justify the need to overcome and perfect the laws and recommend the solutions to ensure the application of criminal record institution in practice.

The proposals and recommendations to continue perfecting the Criminal Code 2015 on criminal record institution are outlined and analyzed in the dissertation which are valuable for the lawmakers to amend and supplement these provisions.

13. Further research directions, if any: Humanization trends in Vietnam's criminal law on criminal records.
