11. Particular outcomes of the thesis

From the theoretical aspect:

- The thesis has analyzed and and clarified the theoretical issues on citizens rights and their assurance in a systematic way to prove the Party and Government points of view, policy and guidelines on human and citizens rights in the society by issuing the regulations stipulated in the Constitution and other legal documents including the administrative procedural regulations.

- Inheriting the propositions of the scientists, the thesis has proposed the definition ”Assurance of citizens rights in administrative procedures” and determined the the contents and legal conditions ensuring the citizen rights in administrative procedures.     

From the practice aspect:

- Thesis has systematically assesssed the current status of citizen rights assurance in administrative procedures through the status of law regulations and their enforcement and implementation of the Administrative Procedures Code with clear determination of rights and responsibilities of the procedural organization/entities, defending lawyers in the administrative judgement execution to ensure the citizen rights, especially the adminstrative court.

- Thesis has recommended solutions to continue the better citizen rights assurance in the administrative procedures.

12. Practical application

Thesis outcomes can be used as teaching and academic references in the research institutes, universities. The outcomes can also be used for the implementation of 2013 Constitution of the Socialist Republic of Vietnam as well as implementation guideline for the 2015 Administrative Procedure Code. More importantly, the solutions suggested in the Thesis are suggestive for practical application towards amending and supplementing the 2014 Law on Organization of the People Court, 2015 Administrative Procedural Code and issuing the Administrative Judgement Enforcement Law.

13. Further research issues

Citizen rights assurance research is an important issue in meeting the implementation requirements of the Vietnam 2013 Constitution. Within the frame of research issue on the citizen rights assurance of the suers /petitioners in the administrative procedures as well as research capacity, The PhD candidate has mainly focused on the fundamental thẻoetical issues such as definition, characteristics, role of citizen rights assurance in the administrative procedures, contents and legal conditions for the citizen rights assurance in the administrative procedures. Therefore, the research should be continued and widened to other entities in the administrative procedures.
